Terms of Service

These terms govern your use of this website and, once you become a client, your use of the KOVACS reporting service. By using this site or engaging KOVACS's services, you agree to these terms.

Who this applies to

KOVACS is built for business use. By using this site or the service, you confirm you're acting on behalf of a business and are authorized to agree to these terms for that business, not as an individual consumer.

The service

KOVACS provides automated security reporting: connecting to security tools you have access to (directly via integration, or via manual import where direct access isn't available) and producing branded, client-ready reports. This website describes that service. The specific scope, pricing tier, and deliverables for a paying client are set out in the agreement made at signup, these terms apply alongside that, not instead of it.

Accuracy of reports

Reports are generated from data supplied by you or pulled from tools you've connected. KOVACS is not responsible for inaccuracies that originate from incorrect, incomplete, or outdated source data. You're responsible for reviewing each report before it reaches your own client, that review step is part of the process by design.

Intellectual property

The KOVACS name, branding, website content, and report templates/formatting are the property of KOVACS. The underlying security data you provide, and the specific findings generated for your clients, remain your property. Using the service doesn't transfer ownership of KOVACS's templates or software to you.

Acceptable use

Don't scrape, reverse-engineer, or attempt to extract the underlying system behind this website or the service. Don't use KOVACS-generated reports to misrepresent a security posture you know to be false. Don't resell or white-label the service itself as your own SaaS product without a separate agreement covering that.

Third-party services

Booking a call uses Calendly. Payment, once applicable, may run through a third-party processor. KOVACS isn't responsible for outages or issues originating from those third-party tools.

Disclaimer of warranties

This site and the service are provided "as is." KOVACS doesn't guarantee uninterrupted availability, and makes no warranty that reports will be error-free, beyond the accuracy limitations already described above.

Limitation of liability

To the maximum extent permitted by law, KOVACS's total liability for any claim arising from use of this website or the service is limited to the amount you've paid KOVACS in the 12 months before the claim arose. KOVACS is not liable for indirect, incidental, or consequential damages, including lost profits or lost business.

Indemnification

You agree to indemnify KOVACS against claims arising from your misuse of the service, your provision of inaccurate data, or your breach of these terms, including claims brought by your own clients.

Termination

Either party may terminate a paid engagement per the cancellation terms in the specific service agreement. Tier changes and pauses follow the terms already described on the pricing section of this site.

Changes to these terms

If these terms change materially, the update date at the top of this page will reflect it. Continued use of the site or service after a change means you accept the update.

Open item, needs your input: governing law and dispute resolution jurisdiction aren't set yet, this depends on where KOVACS is actually incorporated or operating from (Pakistan sole proprietorship vs. a US entity vs. something else), which isn't decided yet as far as I know. That clause needs to be added once that's settled, don't leave it out permanently, an unenforceable or missing jurisdiction clause weakens the liability cap above if this is ever actually tested.
This is a general-purpose draft based on standard SaaS practice, not legal advice, and hasn't been reviewed by an attorney. Reasonable for a pre-launch marketing site. Get it reviewed by a real lawyer once there's real revenue and real client contracts riding on it.
