These terms govern your use of this website and, once you become a client, your use of the KOVACS compliance service. By using this site or engaging KOVACS's services, you agree to these terms.
KOVACS is built for business use. By using this site or the service, you confirm you're acting on behalf of a business and are authorized to agree to these terms for that business, not as an individual consumer.
KOVACS builds and maintains a Written Information Security Plan (WISP) for your firm, based on information you provide about your practice, staff, and vendors. This website describes that service. The specific scope, pricing tier, and deliverables for a paying client are set out in the agreement made at signup, these terms apply alongside that, not instead of it. KOVACS does not provide legal advice, and nothing delivered under this service should be treated as a substitute for advice from a licensed attorney.
Your WISP is built from information you provide about your practice, staff, and vendors. KOVACS is not responsible for inaccuracies that originate from incorrect, incomplete, or outdated information you've supplied. You're responsible for reviewing the document before it's treated as final, that review step is part of the process by design.
The KOVACS name, branding, website content, and document templates/formatting are the property of KOVACS. The finished WISP built for your firm, and the specific information you provide, remain your property. Using the service doesn't transfer ownership of KOVACS's templates or methodology to you.
Don't scrape, reverse-engineer, or attempt to extract the underlying system behind this website or the service. Don't use a KOVACS-built WISP to misrepresent a security posture you know to be false. Don't resell or white-label the service itself without a separate agreement covering that.
Booking a call uses Calendly. Payment, once applicable, may run through a third-party processor. KOVACS isn't responsible for outages or issues originating from those third-party tools.
This site and the service are provided "as is." KOVACS doesn't guarantee uninterrupted availability, and makes no warranty that reports will be error-free, beyond the accuracy limitations already described above.
To the maximum extent permitted by law, KOVACS's total liability for any claim arising from use of this website or the service is limited to the amount you've paid KOVACS in the 12 months before the claim arose. KOVACS is not liable for indirect, incidental, or consequential damages, including lost profits or lost business.
You agree to indemnify KOVACS against claims arising from your misuse of the service, your provision of inaccurate data, or your breach of these terms, including claims brought by your own clients.
Either party may terminate a paid engagement per the cancellation terms in the specific service agreement. Tier changes and pauses follow the terms already described on the pricing section of this site.
If these terms change materially, the update date at the top of this page will reflect it. Continued use of the site or service after a change means you accept the update.
